====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 11-08-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends arrest in connection with Karpurigram P.S. Case No. 16 of 2023 dated 26.03.2023, instituted for the offence punishable under Sections 341, 323, 354, 354 (A), 420, 504, 506, 509 and 34 of the Indian Penal Code and Sections 67 and 67 (a) of the Information Technology Act, 2000.
3. The prosecution case, in short, is that co-accused Ram Balak Singh made indecent video of the informant and started blackmailing and wanted to do wrong with the informant and when the informant made complaint then family members of co-accused Ram Balak Singh along with the petitioner caught
Patna High Court CR. MISC. No.47805 of 2023(2) dt.11-08-2023 2/3 hold hair of the informant and slammed her and further they also assaulted her with fist and slap making her naked.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the allegation is regarding making indecent video of the informant against Ram Balak Singh. It is submitted that Ram Balak Singh is the father of the petitioner and other accused persons who are also the family members of the petitioner. It is submitted that informant is next door neighbour of the petitioner. It is submitted that there is dispute between the parties for drainage of water and some day before exchange of some hot words had taken place between the father of the petitioner and the informant. It is also submitted that on that day petitioner was not in his house but since the petitioner is son of the co-accused Ram Balak Singh as such he has also been dragged into this case. Lastly, it has been submitted that he has no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner in connection

Case No. 16 of 2023, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, subject to condition as laid down under Section 438(2) of the Cr.P.C..
