The petitioner is not named in the first information report of Buxar (T) P.S. Case No.222 of 2014 under Sections 302, etc. of the Indian Penal Code.

Submission is that there is specific allegation of firing at the deceased against accused Harendra Yadav and Ganesh Yadav, whereas two other accused, namely, Vishal Srivastava and Arman are said to have fired at the injured, Shashi Bhushan Mishra.

Regard being had to the facts and circumstances of the case, the petitioner is not firstly named in the first information report and the assailants of the deceased and the injured are definitely named, Let the above named petitioner be released on
