The petitioner has renewed his prayer for bail in connection with Sonbarsa P.S. Case No. 126 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. His sprayer for bail was earlier rejected by this Court vide order dated 04.12.2020 passed in Cr.Misc. No. 31922 of 2020 in view of the fact that the allegation made against him was that he was found involved in the transportation of 370.710 litres of liquor in a truck.

Learned counsel for the petitioner submitted that in the instant case after framing of charge no witness has been examined till date.

Considering the period of about one year and four

Patna High Court CR. MISC. No.57380 of 2021(2) dt.13-04-2022 2/2 months undergone by the petitioner in custody as an under-trial prisoner, nature of the offence and the allegation made against him as also the observation made vide order dated 04.12.2020, whereby the prayer for bail was rejected, to renew his sprayer for bail after nine months in case the trial is not concluded, I am inclined to grant bail. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Sonbarsa P.S.Case No. 126 of 2020.
