The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Complaint Case No. 95 of 2018 for alleged offences under sections 420, 406 of the Indian Penal Code and section 138 of the N.I. Act.

It is submitted by the learned counsel for the petitioner that during pendency of this application, notices were issued to the Opposite Party No. 2 and interim order was passed in his favour. It is further submitted that the matter relates to

Patna High Court CR. MISC. No.66128 of 2018(8) dt.23-10-2019 2/2 bouncing of cheque for Rs. 2,00,000/- (Two Lakhs) which was issued by the petitioner in favour of Opposite Party No. 2. It is submitted by the counsel appearing for Opposite Party No. 2 that the matter has been settled between the parties in the mediation centre with payment of the amount mentioned in the cheque which was issued by the petitioner in favour of Opposite Party No. 2.

In view of the above facts and circumstances, the Court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the Court below within a period of six weeks from today, in connection with Complaint Case No. 95 of 2018, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Benipatti, Madhubani subject to the conditions as laid down in section 438 (2) of the Criminal Procedure Code.
