JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 01-08-2025 Heard Mr. Aditya Raj, learned counsel for the petitioner and Mr. Shantanu Kumar, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bangaon P.S. Case No. 108 of 2022 instituted for the offence under Sections 379, 411 and 34 of the I.P.C.

3. The case of the prosecution is that on 22.07.2022 from the house of the informant, certain valuables worth Rs. 5 Lakh were stolen. He did not inform the police rather he started searching from his own end and on 11.09.2022 from the possession of one Pintu Chaudhary some articles were recovered specifically the locket of God Hanuman. After that, this case was filed. The name of this petitioner has surfaced in the confessional statement of said Pintu Chaudhary.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Nothing except the confessional statement of the coaccused is there against this petitioner. No recovery has been made from his possession. It has also been submitted that it is very strange that the case was filed on 11.09.2022 whereas the date of occurrence is 22.07.2022. Petitioner is having no criminal antecedent.

5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner and submitted that petitioner is a goldsmith and Pintu Chaudhary in his confessional statement has stated that prior to this occurrence also he has sold gold to this petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Bangaon P.S. Case No. 108 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
