2. The petitioner is in custody since 16.06.2014 in connection with Haspura P.S.Case No. 38 of 2014 for the offences alleged under Sections 147, 148, 149, 121, 121-A and 120-B of the Indian Penal Code and Section 25 (1-B)A/26/35 of the Arms Act and Section 17 of the C.L.A. Act.
3. It is submitted that the petitioner has been falsely implicated and there is no recovery of any incriminating article from the conscious possession of the petitioner, who claims clean antecedents. Similarly situated co-accused Akhilesh Yadav has been granted bail by a Bench of this Court in Cr. Misc. No.51684 of 2014.
4. Having regard to the entirety of the facts and
Patna High Court Cr.Misc. No.48953 of 2014 (2) dt.20-02-2015 2/2 circumstances of the case, let the petitioner (Janeshwar Rajbanshi) be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No.38 of 2014 with additional condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
