JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 This is an application for grant of anticipatory bail in connection with Hawai Adda P.S. Case No. 87 of 2018, disclosing offences under Sections 354(A) of the Indian Penal Code and Section 7 of the POCSO Act.

Allegation against the petitioner is of trying to outrage the modesty of eight years old daughter of the informant. Submission of learned counsel for the petitioner is that there is delay of 8 days in lodging the F.I.R. and a case has also been lodged by the wife of the petitioner against the informant of outraging her modesty and as such the present case has been lodged against the petitioner.

Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.66468 of 2018(5) dt.09-04-2019 2/2 anticipatory bail of the petitioner on the ground that during the investigation also several witnesses have supported the allegation against the petitioner.

Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit.

Accordingly, this application is dismissed.
