The petitioner seeks bail in connection with Piri Bazar P.S. Case No. 133 of 2021, dated 01.09.2021, instituted for the offences under Sections 147, 148, 149, 307, 353, 121, 121(A) and 124 of the Indian Penal Code, Sections 25(1-b)a, 26, 27 and 35 of the Arms Act and Sections 16, 17, 18, 20, 21, 22 and 23 of the U.A.P. Act.

There was an exchange of firing between the police party and people belong to naxal group during

Patna High Court CR. MISC. No.47306 of 2022(2) dt.22-12-2022 2/2 elections.

The petitioner has been named in the F.I.R. but only on the basis of the statement made by a police spy. He is said to be in custody since 17.06.2022 and has not been made accused in any case so far apart from the present case.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Lakhisarai in connection with Piri Bazar P.S. Case No. 133 of 2021.

The application stands allowed.
