2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.

3. Earlier prayer for bail of the petitioner was dismissed as withdrawn vide order dated 10.01.2023 passed in Cr. Misc. No. 61296 of 2022.

4. Learned counsel for the State has relied upon a Judgment of Hon'ble Apex Court in the case of G.R. Ananda Babu Vs. State of Tamil Nadu & Anr. reported in 2021 SCC online 176 and submitted that the second anticipatory bail application is not maintainable as it was earlier withdrawn by the petitioner himself.

5. Considering the judgment of the Hon'ble Apex Court, I find that this application is not maintainable.
