JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-08-2017 The petitioner is apprehending his arrest in connection with Jokihat P.S. Case No. 210 of 2012, registered for offences punishable under Sections 341, 323, 504, 379, 304B and 34 of the Indian Penal Code.

Petitioner is husband and allegation against him is of causing dowry death of the deceased.

It has been submitted on behalf of the petitioner that only general and omnibus allegation has been levelled against the petitioner and the informant after realizing his mistake has filed a compromise petition before the Court below.

Learned counsel for the State opposed the prayer for bail and submitted that the case is under Section 304B and the petitioner is a husband.

Patna High Court Cr.Misc. No.36581 of 2017 (2) dt.11-08-2017 Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, his application is, according, rejected.

Let petitioner surrender before the Court below and make prayer for regular bail and if any such application is filed the court below after considering the materials available on record, shall pass an appropriate order, without being prejudiced by the order of this Court.
