====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-07-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor was made from a truck and the owner and the driver of the truck were impleaded as accused. Petitioners are not named in the FIR. Petitioners have stated on oath that they have got no criminal antecedent. Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court

Patna High Court CR. MISC. No.43993 of 2019(2) dt.18-07-2019 2/2 below where the case is pending in connection with S.T. (Excise) Case No. 390 of 2019 and Kishanpur Police Station Case No. 115 of 2019, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
