The petitioner seeks bail in Pipra P.S. Case No. 127 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have assaulted the informant with iron rod on his head. It is submitted on behalf of petitioner that there is case and counter case and both sides sustained injury. The doctor has found two injuries on the head of informant, in which, injury no. 1 is grievous in nature caused by sharp cut weapon, whereas injury no. 2 is simple in nature caused by hard & blunt substance. As a matter of fact, the scuffle took place between the
Patna High Court CR. MISC. No.56818 of 2021(2) dt.10-12-2021 2/2 parties in course of panchayati. Petitioner is in custody since 08.07.2021.
Learned A.P.P. for the State as well as learned counsel for the informant have opposed the bail petition and submitted that one of the injury sustained by the informant is grievous in nature.
However, considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S. Case No. 127 of 2020.
