In this case, the petitioner is seeking anticipatory bail in connection with Dawath P.S. Case No. 102 of 2017 registered for offence punishable under sections 304B, 201, 398A/34, 341, 342, 504, 323 and 325 of the Indian Penal Code. As per allegation, the daughter of informant was married to Arvind Singh. After marriage, the accused demanded motor cycle and golden chain and when it was not fulfilled, allegation has been made that the husband and in-laws jointly assaulted and caused fracture injury to the daughter of informant. She remained in her Maike/Naihar, but after persuasion, she was brought to her Sasusal and later on, she has been killed by the persons named in FIR.
Patna High Court CR. MISC. No.44080 of 2019(2) dt.18-07-2019 2/3 The learned counsel for the petitioner submits that the petitioner has no any way concern with Arvind Singh and his family member, but on account of village politics, he has been implicated in this case.
Looking to the fact that the petitioner was not connected with the family of the husband of deceased, in such view of the matter, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bikramganj, district-Rohtas in connection with Dawath P.S. Case No. 102 of 2017, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
