2. The petitioner has prayed for bail in connection with Khajauli P.S. Case No. 280 of 2024 registered for the offence punishable under Sections 103(1), 61(2), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. The case of the prosecution is that the informant, along with his cousin Amresh Kumar Yadav was going on a bike. As they reached near general store of Anil Yadav, three persons on a bike namely, Raja Babu Sharma, Dinesh Yadav and Shatrughan Yadav (the petitioner), reached near them. It is further alleged that Shatrughan Yadav (the petitioner) gave the pistol to Dinesh Yadav and Dinesh Yadav fired at Amresh
Patna High Court CR. MISC. No.44808 of 2025(3) dt.10-09-2025 2/3 Yadav. After that, they fled away. Amresh Yadav succumbed to the injuries.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that as per the FIR, the only role attributed to this petitioner is that he has handed over the pistol to the main assailant Dinesh Yadav, whereas in this case, Dinesh has given his confessional statement in Para-105 of the Case Diary, and from perusal of his statement, it will transpire that he has stated that he was having the pistol and after the occurrence, he has handed over the pistol to Shatrughan Yadav. The only allegation against this petitioner is that he was accompanying Dinesh on the same bike. Main assailant is Dinesh Yadav. Petitioner was only accompanying him on the bike. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 23.12.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.44808 of 2025(3) dt.10-09-2025 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani, in connection with Khajauli P.S. Case No. 280 of 2024 corresponding to G.R. No. 2791 of 2024.
