Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he gave farsa blow causing head injury to injured Chandrika Sah. Annexure-2 to this petition reveals that one incised wound on the right parietal region measuring 2"x1/5"x1/4" was found and doctor noticed that there was profuse bleeding from the aforesaid injury and on that basis the doctor opined that the above stated injury was dangerous to life.

No doubt, if any injury is found dangerous to life, the

No.48642 of 2014 (4) dt.07-04-2015 said injury comes under the definition of grievous injury but mere profuse bleeding from the injury does not give basis to come on the conclusion that the injury is dangerous to life. However, it is informed on behalf of the petitioner that parties have already compromised this case.

Petitioner is languishing in jail custody since 13.09.2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangita Rani, Judicial Magistrate 1st Class, Sadar, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 160 of 2014.
