It is said that there happens to be apprehension of petitioner along with a motorcycle, which has been snatched away from the informant along with cash, mobile belonging to the informant. Furthermore, the co-accused managed to escape after leaving the motorcycle over which they were riding. It has been submitted on behalf of petitioner that petitioner happens to be under custody since 09.09.2014. Petitioner has got no criminal antecedent. Apart from this, it has also been submitted that petitioner was proceeding on his own motorcycle bearing registration no.BR-33G-0458, at the moment when the occurrence took place and on account of mistaken identity, petitioner along with his own motorcycle has been
Patna High Court Cr.Misc. No.47722 of 2014 (05) dt.14-05-2015 apprehended while the miscreants leaving behind the motorcycle belonging to the informant and other items, escaped. Subsequently thereof, police only to justify apprehension of petitioner, shown recovery from the possession of the petitioner. So, submitted that petitioner is entitled for bail.
On the other hand, learned Additional Public Prosecutor opposed the prayer.
As such, petitioner, Sri Ram Rai @ Ram Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in connection with Dalsingsarai P. S. Case no.439 of 2014.
