Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(b)(ii)(B) of the NDPS Act.

Allegation is that on look at the police party, two persons fled away, leaving their bag. Each bag was containing 2.5 Kg and 3 Kg of intoxicating substance. The F.S.L. report would reveal that the substance was derivative of opium. Petitioner is in custody since 21.08.2020.

Since the petitioner was not apprehended at the time of recovery of Narcotics rather name of the petitioner surfaced on disclosure of some other person, let the petitioner, above named, against whom investigation is already complete and no material is there to substantiate that the petitioner is going to tamper

Patna High Court CR. MISC. No.36 of 2021(3) dt.15-04-2021 2/2 with the evidence, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bousi Police Station Case No.100 of 2017 corresponding to Special Case No.21 of 2017 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
