The petitioner seeks bail in connection with Dumraon P.S. Case No.269 of 2014 registered under Sections 406 and 420/34 of the Indian Penal Code.
The accusation is that the co-accused Manis Bharadwaj took cash Rs.15000/- from the informant on the pretext of providing him job in Garib Nawaj India Gas Private Limited. It is also alleged that the co-accused Manish Kumar and Naushad Ali also took the money from 30 other persons for the same purpose but neither the job has been provided nor the money has been returned to them.
Patna High Court Cr.Misc. No.49481 of 2014 (2) dt.03-03-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. During investigation it has come in the statement of the some of the witnesses that this petitioner was engaged in convincing the people to give the money for that purpose. Except that, there is nothing against the petitioner to connect him in the commission of the alleged offence. Moreover, the co-accused Manis Bharadwaj, against whom there is direct allegation to take the money from the informant for providing him job, has been granted bail by a coordinate Bench of this Court vide order dated 12.11.2014 passed in Criminal Misc. No.41159 of 2014. The petitioner having no criminal antecedent is in custody since 04.08.2014.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxer, in connection with Dumraon P.S. Case No.269 of 2014.
