The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 325, 307, 354, 379, 504, 506/34 and 302 of the Indian Penal Code.
There is general and omnibus allegation of assault against the petitioner also besides some other accused. Specific allegation of commission of head injury with farsa on the person of deceased is against co-accused Krishna Kumar @ Murhi. Considering the general and omnibus nature of allegation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on
Patna High Court Cr.Misc. No.45029 of 2017 (2) dt.20-09-2017 2 /2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur/successor Court in connection with Hasanpur Police Station Case No. 106 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
