The petitioner apprehends arrest in connection with Barari P.S. Case No. 68 of 2017 registered under Sections 147, 149, 323, 354, 354B, 376, 511, 427, 379, 504 and 509 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the complaint case is filed after lapse of 20 days of the alleged occurrence. On perusal of Annexure nos. 2 and 3, it appears that earlier brother of the petitioner has filed a case against the informant and on the date of alleged occurrence, petitioner was on duty.

Having considered the facts and circumstances of the

No.37077 of 2017 (2) dt.31-08-2017 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Katihar in connection with Barari P.S. Case No. 68 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
