JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bhabua P.S. Case No. 160 of 2019 for the offence under Sections 147, 148, 149, 341, 323, 506, 379, 387, 427, 307, 436 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has got clean antecedent and he is in custody since 26.03.2019.

Referring to the prosecution case, learned counsel for the petitioner submits that allegation of firing is against one Rahul and not against this petitioner. He submits that there is allegation of demand of extortion by the petitioner as well as Rahul.
