JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-12-2022 Heard Mr. Sandip Kumar Gautam, learned counsel for the petitioner and Mr. Ashok Kumar Singh, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Teghra P.S. Case No. 177 of 2022 registered for the offences punishable under Sections 406, 420, 419, 468 and 34 of the Indian Penal Code 1860.

As per the First Information Report, the Police got a secret information that some miscreants have assembled near Pethia Gachi and were dealing in illegal arms, gold etc. On the basis of secret information, the Police proceeded towards the place of occurrence and upon seeing the Police Party, the accused persons started fleeing away, however, the Police

From the possession of co-accused Raju Kumar Thakur one metal weighing 1.800 kg. was recovered which the accused persons used to sell by projecting it to be a gold metal. Learned counsel for the petitioner submits that the petitioner is a man of clean antecedent and he has falsely been implicated in this case with oblique motive. He next submits that from the seizure list it would be evident that no incriminating material has been recovered from possession of the petitioner and one Mobile Phone and ATM Cards have been recovered from his possession. The petitioner is in custody since 24.6.2022 and charge sheet has already been submitted. Regards being had to the submission made by the parties and taking into consideration the fact that no incriminating material has been recovered from possession of the petitioner, he is having no criminal antecedent and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai,
