JUSTICE SANJAY PRIYA ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Bhagwanpur P.S. Case No. 102 of 2013, G.R. No. 1615 of 2013 instituted for the offence under Sections 304(B)/34 of the IPC.

Learned counsel for the petitioner has submitted that petitioner is sister-in-law of the deceased.

Learned APP for the State, after looking into paragraph 168 of the case diary has submitted that process under Section 82 and 83 of Cr.P.C. has already been issued and police has also executed the aforesaid process and seized several articles from the house of the petitioner. From the written report, it appears that it is a case of year 2013 and the petitioner has been absconding. In such circumstances, prayer for anticipatory bail is

The petitioner is directed to surrender in the court below and seek regular bail. If the petitioner surrenders, the court below will consider the same taking into account that the petitioner is Nanad of the deceased and will dispose of the same, if possible on the same day without being prejudiced by this order.
