JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2015 Both the above stated petitions arise out of Supaul P.S.Case No. 42 of 2013 registered under Section 304B and 201 of the Indian Penal Code and accordingly both the above stated petitions are being disposed of by this common order. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Admittedly, Petitioner in Cr. Misc. No.33704 of 2014 is husband whereas petitioner in Cr. Misc. No. 48013 of 2014 is father-in-law of the deceased. It is also an admitted position, that

Patna High Court Cr.Misc. No.33704 of 2014 (3) dt.15-01-2015 2/2 after investigation, police submitted charge sheet under section 302, 201/34 of the Indian Penal Code and the dead body of the deceased was found on railway track and no one claimed to have seen the actual killing of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S.Case No. 42 of 2013.
