The petitioners apprehend their arrest in connection with Bihpur P. S. Case No. 14 of 2017 instituted under Sections 365 and 370/34 of the Indian Penal Code.

The allegation, in brief, is that Kunkun Mandal and his wife Baby Devi had sent the son of the informant to work as labourer at Bhagalpur on remuneration of Rs. 2000/- per month and suspicion is raised that accused persons have kidnapped his son and he is traceless.

Learned counsel for the petitioners submits that there is no specific allegation against these petitioners of taking away the son of the informant and Baby Devi, who had sent the son of the informant and other have been granted anticipatory bail by a

Patna High Court Cr.Misc. No.37369 of 2017 (2) dt.10-08-2017 2/2 coordinate Bench of this Court vide Cr. Misc. No. 25596 of 2017 dated 10.07.2017 and except suspicion, there is nothing against them and they have no criminal antecedent.

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Kishun Mandal and Binod Mandal in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 14 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Arun Kumar, J) Sujit/- U
