JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 Heard Mr. Iqbal Asif Niazi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is a lady, apprehending her arrest in G.O. Excise Case No.108/2016 arising out of Kusheshwar Asthan P.S. Case No.246/2016 registered for the offence under Sections 272, 273/34 of the Indian Penal Code and Section 30(a)(c)(d) and 36 of the Bihar Excise Act, has prayed for grant of bail, in the event of her arrest or surrender. It was submitted by learned counsel for the petitioner that the petitioner being wife of Saroj Paswan has been made accused on accusation that from the house of accused Saroj Paswan, recovery of two liters of country-made liquor was shown. It has also been stated that the petitioner is having clean antecedent and this fact has been stated in paragraph-3 of the
Patna High Court Cr.Misc. No.43554 of 2017(2) dt.21-09-2017 2/2 petition.
Considering the fact that the petitioner is a lady, nature of accusation and clean antecedent, let the petitioner, namely, Lal Devi, in the event of her arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Darbhanga in connection with G.O. Excise Case No.108/2016 arising out of Kusheshwar Asthan P.S. Case No. 246/2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
