Heard learned counsel for the parties.
This application for grant of regular bail arises out of Sessions Trial No. 1106/2019 (Masaurhi P.S. Case No. 542 of 2019), disclosing offences punishable under Sections 341, 342,323,324,325,354,307,302/34 of the Indian Penal Code. The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 28.05.2020 passed in Cr. Misc. No. 4530 of 2020 with an observation that the petitioner may renew his prayer for bail after six months and accordingly, this application has been filed renewing prayer for bail. The petitioner is in custody since 27.07.2019.
Patna High Court CR. MISC. No.14024 of 2021(3) dt.04-08-2021 2/2 My attention has been drawn to orders of this Court dated 22.12.2020 passed in Cr. Misc. No. 27380 of 2020 and dated 16.03.2021 passed in Cr. Misc. No. 425 of 2021, whereby similarly circumstanced co-accused Sujay Singh and Munna Mishtri respectively, have been allowed regular bail. Copies of the said orders have been brought on record by way of Annexures 3 and 3/A to the supplementary affidavit filed on behalf of the petitioner.
Considering the petitioner's period of custody and the orders passed by this Court, whereby another co-accused persons have been allowed regular bail, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Masaurhi, Patna in connection with S.T. No. 1106 of 2019 arising out of Masaurhi P.S. Case No. 542 of 2019.
