The petitioner is apprehending his arrest in a case in connection with Benipati P.S. Case No. 65 of 2022 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 136.50 litres of illicit liquor from the house of the petitioner.

Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in this case and he has committed no offence.

Learned A.P.P appearing on behalf of the State has

Patna High Court CR. MISC. No.47313 of 2022(2) dt.11-11-2022 2/2 vehemently opposed the prayer of the petitioner and submitted that the recovery of illicit liquor has been made from the house of the petitioner.

Considering the fact that place of recovery belongs to the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
