03-03-2015 Heard learned counsel for the petitioner and Sri M.K.Khare, learned Addl. Public Prosecutor.

The petitioner, who is mother-in-law of deceased and is in custody in Kesariya P.S. Case No.106 of 2013 registered for the offence under Sections 498A, 304B and 34 of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner submits that in the F.I.R. there was specific accusation against the husband of the deceased by the informant (mother of the deceased). However, the husband of the deceased, namely, Jitendra Mukhiya has been granted bail by order dated 09.06.2014 passed in Cr.Misc.No.20852 of 2014. Similarly, the husband of the petitioner, namely, Ekbal Mukhiya has been granted bail on

Patna High Court Cr.Misc. No.49415 of 2014 (2) dt.03-03-2015 2/2 21.03.2014 vide Cr.Misc.No.6377 of 2014.

Keeping in view the fact that other accused persons having similar accusation have been granted bail, there is no reason to deny the privilege of bail to the petitioner. Let the petitioner Rajwanti Devi be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.Kumar learned Judicial Magistrate, 1st Class, East Champaran at Motihari in connection with Kesariya P.S. Case No.106 of 2013.
