Mr. Mukeshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2021 Heard Ms. Soni Srivatava, the learned counsel for the petitioner and Mukeshwar Dayal, learned counsel for the State.
The petitioner seeks bail in anticipation of his arrest in connection with Belaganj P. S. Case No. 118 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 337, 307, 379, 504 and 506 of the Indian Penal Code.
The accusation in the F.I.R. is that several persons including the petitioner took part in the affray and the petitioner is specifically alleged to have assaulted the informant by means of a butt of a gun.
Patna High Court CR. MISC. No.2712 of 2021(2) dt.20-07-2021 2/3 The learned counsel for the petitioner has drawn the attention of this Court to the fact that there is a counter version of the occurrence in which the petitioner has also been injured.
The informant has received an injury, the nature of which has yet not been assessed.
However, it has been submitted that looking at the dimensions of the injury, even though it is found to be on the parietal region, it does not appear to be grievous in the first sight.
Apart from this, it has been submitted that the dispute arose because of competing claims over a particular plot of land. The parties have been at loggerheads from before and some time prior to the occurrence, there was a reported case between the parties.
For the reasons afore-stated and the background facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing
Patna High Court CR. MISC. No.2712 of 2021(2) dt.20-07-2021 3/3 bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., XI, Gaya, in connection with Belaanj P. S. Case No. 118 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
