2. Petitioner seeks bail who is in custody since 04.11.2022 in connection with Sessions Trial No. 122 of 2023 arising out of Lakhisarai (Kabaiya) P.S. Case No. 685 of 2021, F.I.R. dated 10.10.2021 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354B, 379, 504 of the IPC and later on, Section 302 of the IPC was added.

3. According to prosecution case, the petitioner along with other co-accused persons armed variously came to the house of the informant and started abusing her. It is further alleged that they tried to outrage the modesty of the daughter-inlaw of the informant and they also assaulted the informant.

4. Earlier, the bail petition of the petitioner was rejected by this Court vide order dated 27.04.2023 passed in Cr. Misc. No. 5421 of 2023.

5. Learned counsel for the petitioner submits that petitioner has clean antecedent. He further submits that the petitioner is in custody since 04.11.2022 and the trial has not been concluded as yet.

6. Vide order dated 11.07.2025, a report was called for with regard to the present stage of trial. Report of the learned Trial Court dated 23.07.2025 reveals that out of five chargesheet witnesses, only three witnesses have been examined and the trial is pending for examination of the rest of the prosecution witnesses.

7. The learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

8. Considering the aforesaid facts, nature of allegation as alleged in the FIR as well as report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 122 of 2023 arising out of Lakhisarai (Kabaiya) P.S. Case No. 685 of 2021 pending in the court of learned Additional District and Sessions Judge-III, Lakhisarai.

9. Prayer is refused.

10. However, learned Trial Court is directed to expedite and conclude the trial at the earliest.
