JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 07.07.2014. The contention on behalf of the petitioner is that the deceased consumed Salphas on account of petty family dispute and while she was being taken to hospital by the petitioner and his other family members, she died on the way.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to grant privilege of bail to the petitioner, accordingly, his prayer for bail in connection with Tekari P.S.Case No.123 of 2014, pending in the court of Chief Judicial Magistrate, Gaya stands rejected, at

Patna High Court Cr.Misc. No.50520 of 2014 (5) dt.01-04-2015 2/2 least, at this stage.

However, learned Chief Judicial Magistrate, Gaya is directed to commit the case of the petitioner to the court of session in accordance with law within three weeks from the date of receipt / production of copy of this order and after commitment, the concerned sessions court shall take all possible steps to conclude the trial of the petitioner as early as possible.
