JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-04-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner seeks bail in anticipation of his arrest in connection with Bakhtiapur P. S. Case No. 297 of 2018, instituted for the offences under Sections 341, 323, 498A and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961.

As per allegation made in the F.I.R., the petitioner was married to the informant in the year 2016. The informant, after her marriage, was residing with her husband in Mumbai, but all of a sudden, she was sent to Patna. Thereafter, the petitioner and in-laws inflicted physical and

The learned counsel for the petitioner has submitted that the petitioner is ready to keep his wife with full dignity and honour. He has also submitted that Rs. 11,000/- monthly is being deducted from the salary of the petitioner and being paid to the informant.

The matter was referred to the District Mediation Centre. The report of the mediation shows that on some occasion, the informant, Bharti Kumari was present and the petitioner was absent, whereas on some dates, the petitioner was present and the informant was absent before the Mediator.

The learned counsel for the informant fairly admitted that she is getting maintenance from the petitioner. Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten
