The petitioner apprehends his arrest in connection with Panapur P.S. Case no. 01 of 2017, registered under Sections 363 and 366(A)/34 of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant by the petitioner with the help of his other family members for the purpose of marriage.
Learned counsel for the petitioner submits that, in fact, at the time of occurrence, the daughter of the informant was not minor, rather, she was aged about 18 years, which would appear from her Aadhar Card, which is Annexure-3. Further submission is that, in fact, petitioner and daughter of the informant left the house according to their sweet will and
Patna High Court CR. MISC. No.45785 of 2019(2) dt.24-07-2019 2/2 later on, they performed marriage. The informant and his daughter filed an application in ABP No. 1866 of 2018 in the Court of Addl. Sessions Judge-I, Saran stating that the daughter of the informant has performed marriage with the petitioner and they are leading their conjugal life happily. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Saran at Chhapra in connection with Panapur P.S. Case No. 01 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
