1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Amarpur P.S. Case No. 209 of 2023 dated 27.03.2023 registered for the offence(s) punishable under Section(s) 392 and 411 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a young person having fair and clean antecedent, as per order impugned the looted motorcycle is stated to have been recovered in following with the confessional statement of this petitioner and co-accused Ripu Kumar but it does not appear that the said recovery was made in following with the statement made by this
Patna High Court CR. MISC. No.48690 of 2023(2) dt.04-08-2023 2/2 petitioner and he has been languishing in jail since 05.04.2023. Further submissions are that after petitioner's arrest, he was not put on Test Identification Parade (T.I.P.) and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly the petitioner's young age, his fair and clean antecedent and the completion of investigation against him, this Court is inclined to accept his bail prayer. Accordingly, let the petitioner namedabove be enlarged on bail in connection with Amarpur P.S. Case No. 209 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
