BAJANTHRI ORAL JUDGMENT Date : 27-01-2022 This matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 Pandemic. Mr. Prashant Pratap, learned State Counsel accepts notice for respondent nos. 6 & 7.

Service of notice to seventh respondent-Sunita Devi is dispensed with since no adverse order is passed against her. In the instant petition, petitioner has prayed for the following relief(s):-

Patna High Court CWJC No.2418 of 2021 dt.27-01-2022 2/3 "(i) For a mandamus commanding and direction to the respondents to cancel/remove the selected candidate namely Sunita Devi, W/o Awadhesh Rai, from the post of Anganbari Sevika at Gram Panchayat Basahi, Ward No. 12, Anganbari Centre No. 100, Block Lahladpur, P.S.-Janta Bazar, Saran who has been illegally selected on the basis of fake matric certificate by ignoring the applicable candidate namely Suganti Devi (petitioner), by the corrupt practices of the selecting committee who have been favoured the meritless candidate namely Sunita Devi (Respondent No. 7).

(B) For a direction to the respondents to select the petitioner for the post of Anganbari Sevika at Gram Panchayat Basahi, Ward No. 12, Centre No. 100, P.S.-Janta Bazar, Distt.-Saran after cancelling the illegal selected candidate namely Sunita Devi who is not eligible for Anganbari Sevika post.

(iii) For a direction to the higher concerning authority to take action against the Selecting Committee and concerning C.D.P.O., Lady Supervisor, Child Development Project, Lahladpur, Saran who has illegally selected the illegal candidate for the post of Anganbari Sevika at Basahi Panchayat, Ward No. 12, Centre No. 100, Lahladpur, Saran.

In support of the aforesaid relief petitioner submitted representations dated 01.09.2020 and 01.10.2020 vide Annexure- 4 and 5. The concerned respondent has not taken any decision on the petitioner's representation.

Patna High Court CWJC No.2418 of 2021 dt.27-01-2022 3/3 Therefore, the concerned respondent is hereby directed to decide the petitioner's representations dated 01.09.2020 and 01.10.2020 vide Annexure-4 & 5 and proceed to pass speaking order after giving due opportunity of hearing to the petitioner and seventh respondent-Sunita Devi and communicate the same to the petitioner within a period of three months from the date of receipt of this order.

With the aforesaid observations, the present writ petition stands disposed off.
