This application, for grant of anticipatory bail, arises out of Baniyapur P.S. Case No. 123/2017, disclosing offences under Sections 147, 149, 323, 324, 307, 379 and 504 of the Indian Penal Code and section 27 of the Arms Act.
From the First Information Report, it appears that occurrence had taken place over cutting of tree in the informant's field by the accused persons.
It is alleged against the petitioners that they opened fire. From the F.I.R. itself, it is evident that no one received any firearm injury. Petitioners have no criminal antecedent. Let the petitioners above named, in the event of their
Patna High Court Cr.Misc. No.43149 of 2017 (2) dt.21-09-2017 2/2 arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XI, Saran at Chapra in connection with Baniyapur P.S. Case No. 123/2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
