Heard the learned counsel for the petitioner and the State.
The petitioner seeks bail in anticipation of his arrest in connection with Kotwali (Basudeopur) P. S. Case No. 121 of 2017 dated 11.04.2017 instituted for the offences under Sections 323, 324, 307, 379 and 504 of the Indian Penal Code.
The petitioner is alleged to have assaulted the informant and others by means of a lathi. There appears to be a family dispute where even the son-in-law and daughter-
Patna High Court Cr.Misc. No.61563 of 2018(3) dt.25-01-2019 2/2 in-law of the informant has been made accused. The petitioner is none-else but Samdhi of the informant. It has been submitted on behalf of the petitioner that the person against whom there is an allegation of assault by sword has been granted bail by the court below. Considering the afore-stated facts as also that there is a Title Suit pending between the family members of the informant and the petitioner, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, District - Munger in connection with Kotwali (Basudeopur) P. S. Case No. 121 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
