The present writ petition has been filed by the petitioner for issuance of a writ in the nature of mandamus directing the respondent authorities to consider the case of the petitioner for appointment on compassionate ground, in place of his mother late Amrita Sinha, who died in harness on 29.07.2020, while working as A.N.M. in the

Learned Counsel for the petitioner submits that he has filed representation in prescribed format and thereafter filed representation (Annexure-P/2) to the Chief Medical Officer and subsequent representation was also made through registered post, but no response has been made from the concerned respondents.

4. Learned Counsel for the State submits that from the records it transpires that the petitioner has made representation only to the Chief Medical Officer, but has not filed any application before the District Magistrate.

5. In this view of the matter, the petitioner is hereby directed to file fresh representation before respondent No.4, the District Magistrate-cum-Chairman, District Compassionate Committee, West Champaran, Bettiah, within 30 days and respondent No.4, the District Magistrate-cum-Chairman, District Compassionate Committee, West Champaran, Bettiah, is hereby directed to take decision on the representation filed by the petitioner within 90 days thereafter and take decision in accordance with law.
