As soon as informant, Suman Lakhotiya came along with her husband Yogesh Lakhotiya, miscreants arrived and attempted to snatch away two jholas having in the hand of Suman Lakhotiya which was resisted and during course thereof, the miscreants fired causing injury to Yogesh Lakhotiya and then thereafter, escaped with two jholas. It is also apparent from the case diary that miscreants were chased and during course thereof, one Bechan Mian was apprehended by the villagers who was latter on handed over to police. The name of the petitioner cropped up over inculpatory extra judicial confessional statement of aforesaid Bechan Mian. Subsequently thereof, the police not even cared to put the petitioner on T.I. Parade. Petitioner happens to be under custody since 05.06.2014. Petitioner though had chequered history but on account of aforesaid deficiency did not justify his further incarceration.

Patna High Court Cr.Misc. No.48699 of 2014 (3) dt.31-03-2015 Accordingly, petitioner Md. Subhan @ Subhan is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.136 of 2011.
