2. The petitioner seeks regular bail in connection with Govindganj P.S. Case No. 228 of 2024 registered for the offence punishable under Sections-341, 323, 307, 353, 504, 34 of the Indian Penal Code and Sections-37 & 45 of the Bihar Prohibition & Excise (Amendment) Act-2022 (For short, IPC).

3. Allegedly, in the backdrop of land dispute, while the informant along with some other officials reached villageRadhiya for inspection and physical verification of the site, the petitioner is said to have misbehaved with the informant and consequently, the petitioner is said to have pressed the neck of the informant with intention to kill him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Though there is allegation in the FIR that the petitioner was found in drunken state after breath analyzer test but the same has not been confirmed by blood test. The petitioner is under custody since 06-06-2024 and charge sheet has been submitted in this case.

5. Learned counsel appearing for the State has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Civil Court, East Champaran, Motihari in connection with Govindganj P.S. Case No. 228 of 2024 subject to the condition that the petitioner will cooperate in trial and shall make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
