2. The petitioner has preferred this application for grant of regular bail in connection with Batiya P.S. Case No. 06 of 2024 dated 17.03.2024 registered for the offences punishable u/ss 363 and 366 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, three unknown miscreants are alleged to have abducted the informant's daughter aged about 19 years.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has transpired during the course of investigation. It is further submitted that the victim in her statement recorded under Section 164 of the Cr.P.C. has not stated that the victim was forced

Patna High Court CR. MISC. No.49678 of 2024(3) dt.22-08-2024 2/2 or seduced to have illicit intercourse with another person. She has further stated that the petitioner did nothing with her. Learned counsel has further submitted that the victim is a major girl aged about 19 years. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.03.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner. Learned counsel has further submitted that the victim is a minor girl as per the school certificate issued by Bihar School Examination Board.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Batiya P.S. Case No. 06 of 2024.

7. The application stands allowed.
