The petitioner apprehends her arrest in Jamhore P.S. case No. 14 of 2017 for the offences punishable under Section 420 and other Sections of the Indian Penal Code.

The informant intercepted three trucks bearing registration Nos. JH02S-8188, JH01AR-2670 and JH14A-4654. The drivers of the trucks were unloading coal in the brick kiln, M/s Shakti Traders, situated in village Rampur Tendua, district Aurangabad, Bihar although chalan in possession of the truck drivers show that the coal were loaded for transportation and unloading in Hariharganj, Palamu, Jharkhand.

The learned counsel for the petitioner submits that petitioner is owner of one of the trucks bearing registration No. JH14A-4654. The petitioner is not at all responsible as valid documents were handed over to the driver of the truck, who is

On similar allegation, Shyam Sunder Singh and Ashok Kumar Singh, two owners of the trucks, seized along with truck of the petitioner, have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 25467 of 2017 and the case of petitioner stands on similar footing. Moreover, the petitioner is a lady.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S. case No.14 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
