JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-02-2021 Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned APP for the State. This is the second attempt of the petitioner to obtain regular bail in connection with GRP/Kiul (Nawada) P.S. Case No. 53 of 2019 registered for the offences punishable under Section 395 of the Indian Penal Code.

It appears from the letter no. 12 dated 08.02.2021 of learned Additional Sessions Judge 3rd, Lakhisarai that the case is fixed for prosecution evidence and it may take three months' time to conclude this case.

Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was rejected vide order dated 03.12.2019 passed in Cri. Misc. No. 62550 of 2019. Learned counsel submits that the petitioner is in custody since 27.03.2019 and the trial is not progressing well. Learned APP for the State has opposed the prayer for bail

Having regard to the facts and circumstances of the case, whereunder earlier the prayer for bail of the petitioner was rejected and now the learned trial court has informed this Court that the case is fixed for evidence of the remaining prosecution witnesses as also that three months' time is likely to be taken in conclusion of trial, this Court is not inclined to grant bail to the petitioner. Let the trial be concluded preferably within a period of three months.

The Superintendent of Police, Lakhisarai is directed to ensure appearance of all the prosecution witnesses as well as the production of the accused for purpose of trial on the date fixed in the matter.

If the trial remains unconcluded for no reasons attributable to the petitioner, he may renew his prayer for bail. This application stands disposed of accordingly.
