Petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 325, 308, 379, 504, 506/34 of the Indian Penal Code.

Informant in his written complaint has alleged that when he prevented his co-villager Dinesh Singh from tying the cattle in the open space in front of his house, accused, Ram Singh and Golu Singh armed with Khanti and iron rod entered into his house and started assaulting him and Dinesh Singh assaulted him on his head on account of which he fell down and when the wife of the Informant came to save him, she was also assaulted with fists and slaps.

It has been submitted on behalf of the petitioner that incident is result of land dispute. It has been further submitted

Patna High Court CR. MISC. No.57580 of 2021(2) dt.30-03-2022 2/2 that the petitioner and informant are agnates. Petitioner has got no criminal antecedent and is in custody since 16.04.2021. Charge-sheet has already been submitted.

Learned counsel for the Informant vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Pakribarawan P.S. Case No. 29 of 2020, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
