The petitioners seek bail in Dhaka P.S. Case No. 247 of 2013, registered for the offence punishable under Section 387 of the Indian Penal Code.

The informant alleged that from the mobile no. 7654175639 call was made on his mobile no. 9931309749 and caller demanded extortion of Rs. 30 lakhs.

Learned counsel for the petitioners submits that the petitioners are not named in the FIR. During the course of investigation, the investigating officer did not find out, as to who is the owner of the SIM card no. 7654175639. One Sunny Singh

Patna High Court Cr.Misc. No.49467 of 2014 (3) dt.22-04-2015 2/2 was arrested and he confessed his guilt and admitted that he along with other member of Azad Hind Fouz demanded extortion. Except the confessional statement of Sunny Singh and Dipak Kumar the investigating officer did not collect any other material to show the involvement of the petitioner in demand of extortion. Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sikranah, Motihari in connection with Dhaka P.S. Case No. 247 of 2013.
