JUSTICE SUDHIR SINGH ORAL ORDER 22-01-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 379, 354, 504, 506/34 of the Indian Penal Code.

The prosecution case, in short, is that the accused persons including the petitioners assaulted the informant and his son by lathi and sharp cutting weapon, due to which they sustained injuries.

It has been submitted on behalf of the petitioners that there

Patna High Court Cr.Misc. No.66071 of 2018(3) dt.22-01-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. From paragraph 44 of the case diary, it is evident that the independent witness has denied the allegation. As per the statement of the said witness, some altercation had taken place in the Barat, which led to institution of the present case with false allegation.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Bhagwanpur Hat P.S. case No.133 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
