2. In this case, the petitioner is seeking regular bail in connection with Hisua P.S. Case No. 266 of 2024, registered for the offences punishable under Sections 20(b)(ii)(B) of the NDPS Act, 1985.

3. As per allegation, the informant along with other police party reached the place of occurrence. Seeing the police party, the accused persons including this petitioner started fleeing away but were apprehended. On search, 5 kg of ganja was recovered from their possession. Three mobile phones and Rs. 3800/- cash were also alleged to have been recovered.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.50514 of 2024(2) dt.24-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is not the owner of the alleged motorcycle. No incriminating material was recovered from his possession and he is under custody since 15.05.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that huge quantity of ganja was recovered from possession of the petitioner.

6. Presently, this criminal miscellaneous petition is rejected with the observation that the petitioner may renew his prayer for bail after framing of the charges or after six months in custody, whichever is earlier.
