JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 420, 467, 468, 471 and 120B of the Indian Penal code and Section 17, 18, 18(b), 21, 38 and 40 of Unlawful Activities Prevention Act.

As per the allegation, a gang helping the terrorist was apprehended.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and his name figured in the confessional statement of co-accused. He further submits that petitioner has no criminal antecedent.

On the other hand, learned Additional Public Prosecutor submits that the petitioner is a member of the gang and his name has been disclosed by another apprehended accused.

However, if the petitioner surrenders before the court below (Chief Judicial Magistrate, Lakhisarai) in connection with Lakhisarai P.S. case no. 454 of 2013 within four weeks from today and prays for regular bail, the same would be disposed of preferably on the same day without being prejudiced by this order.
