Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Laheri P.S. Case No. 170 of 2022, lodged under Sections 447, 448, 341, 323, 504, 354(B), 307/34 of the Indian Penal Code. As per prosecution case, the informant had alleged that the accused persons including the present petitioner has came to her house and started knocking the door when gate was opened, then they snatched her dupatta and started outraging her modesty and also abuses her. Upon her cry, her husband came then all 3 had assaulted her husband with rod and danda, in result the husband of the informant has got injured and

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that for the same date and place of occurrence there are two F.I.Rs., one F.I.R. is Laheri P.S. 169 of 2022 filed by the accused of the present case and another is the present case i.e. Laheri P.S. 170 of 2022. Learned counsel also submits that it is a dispute between two brothers for family matters and the petitioner is unnecessarily being made accused in this case. He further submits that injury is from both the sides which are annexed here. He further submits that antecedent of the petitioner is clean, he is in custody since 02.07.2022 and chargesheet has already been filed in this case. Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 170 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
